Welcome to Qawiya Fitness Studio. These Terms and Conditions ("Terms") govern your use of our fitness facility, services, and programs. By signing up for membership or using our services, you agree to be bound by these Terms.
1. Membership Terms
1.1 Membership Types
Qawiya Fitness Studio offers various membership options including monthly, annual, and class-based packages. Specific terms for each membership type are outlined in your membership agreement.
1.2 Membership Activation
Your membership begins on the date specified in your membership agreement. All memberships require completion of our health screening questionnaire and waiver forms.
1.3 Membership Privileges
Members have access to designated areas of the facility during operating hours, subject to availability and these Terms. Some specialized programs may require additional fees.
1.4 Non-Transferable
Memberships are personal and non-transferable. Members must present valid identification when requested.
2. Payment Terms
2.1 Fees and Charges
All membership fees, personal training sessions, and additional services must be paid according to the agreed schedule. Prices are subject to change with 30 days' written notice.
2.2 Payment Methods
We accept various payment methods including credit cards, debit cards, and electronic bank transfers. Automatic payment authorization may be required for certain membership types.
2.3 Late Payments
Late payment fees may apply for overdue accounts. Continued non-payment may result in membership suspension or termination.
2.4 No Refunds
Membership fees are generally non-refundable except as specifically outlined in our cancellation policy or required by applicable law.
3. Health and Safety Requirements
3.1 Health Clearance
Members must be in adequate physical condition to participate in fitness activities. We strongly recommend consulting with a physician before beginning any exercise program.
3.2 Medical Conditions
Members must disclose any medical conditions, injuries, or physical limitations that may affect their ability to exercise safely. Failure to disclose such information may void liability protections.
3.3 Age Requirements
Members under 18 must have parental consent and may have restricted access to certain areas or equipment. Specific age-related policies are available upon request.
3.4 Personal Responsibility
Members exercise at their own risk and are responsible for using equipment properly and within their physical capabilities.
4. Facility Rules and Conduct
4.1 Operating Hours
Facility hours are posted at the entrance and may vary by season or special circumstances. We reserve the right to modify hours with reasonable notice.
4.2 Dress Code
Appropriate athletic attire and closed-toe shoes are required at all times. Specific dress requirements may apply to certain areas or classes.
4.3 Equipment Use
Use equipment only as intended and according to posted instructions
Wipe down equipment after use with provided cleaning materials
Respect time limits on cardiovascular equipment during peak hours
Report damaged or malfunctioning equipment immediately
4.4 Prohibited Behavior
The following behaviors are strictly prohibited:
Harassment, discrimination, or inappropriate conduct toward staff or members
Use of profane, threatening, or offensive language
Photography or recording without express written consent
Bringing outside food or beverages (except water)
Smoking, vaping, or alcohol consumption
Bringing weapons or illegal substances
4.5 Personal Belongings
Qawiya Fitness Studio is not responsible for lost, stolen, or damaged personal property. Use of lockers and secure storage is recommended.
5. Liability and Risk Assumption
5.1 Assumption of Risk
Members acknowledge that physical exercise involves inherent risks including but not limited to muscle strains, sprains, fractures, heart attack, or even death. Members voluntarily assume these risks.
5.2 Release of Liability
Members agree to release, waive, discharge, and hold harmless Qawiya Fitness Studio, its owners, employees, instructors, and agents from any and all liability, claims, demands, or causes of action arising from participation in fitness activities.
5.3 Indemnification
Members agree to indemnify and hold harmless Qawiya Fitness Studio from any claims arising from their conduct or breach of these Terms.
5.4 Limitation of Liability
To the maximum extent permitted by law, Qawiya Fitness Studio's liability is limited to the amount of membership fees paid by the member.
6. Cancellation and Termination
6.1 Member Cancellation
Members may cancel their membership according to the specific terms outlined in their membership agreement. Written notice is typically required, and certain membership types may have minimum commitment periods.
6.2 Studio Termination
Qawiya Fitness Studio reserves the right to terminate any membership immediately for:
Violation of these Terms or facility rules
Inappropriate or disruptive behavior
Non-payment of fees
Providing false information during registration
6.3 Refund Policy
Refunds for canceled memberships will be processed according to the specific terms of the membership agreement and applicable law.
7. Messaging and Communications Consent
7.1 Message Types and Consent
By providing your mobile phone number and agreeing to these Terms, you expressly consent to receive the following message types from Qawiya Fitness Studio via SMS/text messaging through our Grasshopper messaging platform:
Message Type 1: Conversational Messaging
Messages answering customer questions and two-way conversational messaging
Customer service responses and support communications
Message Type 2: Transactional/Relationship Messages
Standard notifications about customer purchases or relationship with our business
Membership confirmations, payment notifications, class bookings, and account updates
Operational communications related to your membership and services
Message Type 3: Promotional Messages
Marketing messages promoting our products and services
Special offers, new class announcements, and promotional content
7.2 Message Flow (CTA)
By providing your mobile phone number, you consent to receive messages from Qawiya Fitness Studio with the following specifications:
Message Types and Frequencies:
Conversational Messages:
Message Type: Conversational messaging for answering customer questions and two-way conversational messaging
Message Frequency: As needed based on customer inquiries and interactions (varies by customer engagement)
Transactional/Relationship Messages:
Message Type: Standard notifications about customer purchases or relationship with our business
Message Frequency: Up to 10 messages per month including membership confirmations, payment notifications, class bookings, and account updates
Promotional Messages:
Message Type: Marketing messages promoting our products and services
Message Frequency: Up to 4 messages per month including special offers, new class announcements, and promotional content
7.3 Message Charges
Standard message and data rates may apply from your mobile carrier. Qawiya Fitness Studio does not charge for messages, but carrier charges may apply.
7.4 Opt-Out Instructions
You can opt out of receiving messages at any time by:
Replying "STOP" to any message
Contacting us directly at [phone number] or [email]
Visiting our facility to update your preferences
7.5 Opt-Out Scope
Replying "STOP" will opt you out of all message types listed above
You cannot selectively opt out of individual message types while maintaining others
Opting out may affect your ability to receive important account and service updates
7.6 Help and Support
For help with messaging services, reply "HELP" to any message or contact us at [phone number].
8. Privacy and Data Protection
8.1 Information Collection
We collect personal information necessary for membership management, including contact information, emergency contacts, health-related data, and mobile phone numbers for messaging services.
We only use your personal and mobile information for purposes directly related to providing and maintaining our services, and do not share it with third parties except as necessary for these business operations.
8.2 Information Use
Personal information is used for membership management, the three message types specified above (conversational messaging, transactional/relationship messages, and promotional messages), safety purposes, and improving our services. We do not sell personal information to third parties.
8.3 Information Sharing
We may share information with emergency contacts, medical personnel in case of emergency, our messaging service providers (Grasshopper), or as required by law.
8.4 Data Security
We implement reasonable security measures to protect member information, though no system is completely secure.
9. Classes and Personal Training
9.1 Class Registration
Some classes may require advance registration and may have capacity limits. No-show policies may apply.
9.2 Class Modifications
Class schedules, instructors, and formats may change with reasonable notice. Substitute instructors may be provided when necessary.
9.3 Personal Training
Personal training sessions are subject to separate agreements and cancellation policies. Rates and policies are available upon request.
10. General Terms
10.1 Modifications
Qawiya Fitness Studio reserves the right to modify these Terms at any time. Members will be notified of significant changes via email or posted notices.
10.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
10.3 Governing Law
These Terms are governed by the laws of New Jersey without regard to conflict of law principles.
10.4 Dispute Resolution
Any disputes arising from these Terms or membership will be resolved through court jurisdiction in Saddle Brook, NJ.
10.5 Entire Agreement
These Terms, together with your membership agreement, constitute the entire agreement between you and Qawiya Fitness Studio.
